Bill of Rights and Obligations

Effective 16 May, 2013

 

I. Bill of Rights

1. All nations of The West Pacific are sovereign and have the right of self-determination in domestic policies, including NationStates Issues and World Assembly Voting.

2. Rights to free speech, free press, and free expression of religion will not be infringed as long as the expressed freedoms do not [a] violate the same rights of others, {b} violate the ToS of this Forum. The Delegate, and/or the Forum Owner or his designees shall be the ultimate judges of propriety. These rights may not override the right of The Delegate to exercise his/her ingame authorities.

3. Participation in The West Pacific Government, Offsite Forum, and TWP Military shall be voluntary.

4. All nations of The West Pacific have the right to participate and vote in accordance with the regional law.

 

5. No nation of The West Pacific holding WA member status shall be obligated to endorse any other nation of The West Pacific. The right to add an endorsement or withdraw an endorsement will remain a sovereign right of the WA member nation.

6. All nations of The West Pacific have the right to appeal any official decision or action to The Delegate or those so designated by The Delegate.

7. These Rights listed are not exhaustive. Other Rights may be defined and existing Rights may be expanded through legislative action of The The Holy Grand Assembly of the West with the concurrance of The Delegate.


II. Bill of Obligations

In keeping with the NationStates rules of etiquette, the following behaviors will constitute grounds for immediate banjection from the region:

1. Posting of any content considering spamming, content that is considered obscene, illegal, threatening, malicious or defamatory. This applies to a nation's name, motto and other customizable fields, any messages written, images posted, or any other content uploaded or linked to NationStates.

2. Attempting to steal another nation's identity is fraudulent behavior and breaches the NationStates terms & conditions. The same applies to any attempt to impersonate another player, including attempting to hack nations, regions, or forum passwords.

 

3. Attempts at forum destruction anywhere in NationStates will result in banning from the region and the forum in accord with the COPS Treaty.

4. Members of enemy regions or organizations may be banjected at the discretion of the Delegate.

 

5. The Delegate reserves the right to banject any nation acting in an inappropriate manner.

The Judiciary of The West Pacific

The Judiciary of The West Pacific will be a fair and fact-based venue for hearings that enforce the laws of TWP, support the acts of the The Holy Grand Assembly of the West and help represent the policies of The Delegate. The Judiciary serves to support the government of TWP by providing a fair and impartial support service to those who have the ultimate responsibility for the region.


Legislative Requirement: All powers of the Judiciary shall be enumerated by the Government, and it is from there that the authority of the Judiciary derives. The Judiciary may be suspended or abolished by the Government by that same authority.


Leadership: The Judiciary shall have has its Chief Judicial Officer the Chief Justice. The authority and responsibilities of the Chief Justice shall flow from the enumerated powers assigned to the Judiciary.

Development: The initial Charter for Judiciary in intentionally brief and vague. The intent of the Judiciary is to grow and evolve it’s procedures in tandem with Government and Delegate of The West Pacific.

1. Legislation: The Judiciary and the Chief Justice will be granted no unique power to create, pass or amend any law.

2. Law Enforcement: The primary purpose of the Judiciary will be to enforce the laws of the region, as created by the Government. The Judiciary will stand ready to accept and review all complaints and allegations of actions contrary to the law and evaluate them based on all available, factual evidence. The merit of such evidence will be determined by legislation and the acceptance of prior hearings by the Government.

3. Opinions: Upon request of any member of the region in good standing, the Judiciary will provide a written opinion on any matter of law or procedure for the purposes of clarifying an issues or adding possible options for a procedure. These opinions are non-binding.

4. Legislative Opinion: If any member of The Holy Grand Assembly of the West wishes, the Judiciary can also provide an opinion on proposed legislation for the purposes of identifying conflicts or contradiction.

The Regional Assembly of Nations of The West Pacific Act

Effective 17-August-2013, Modified 11-April-2015

 

 

1. There shall be a Regional Assembly of The West Pacific that will sit in continuous session.

i. The Regional Assembly may change its name by simple majority vote.

2. The Regional Assembly may not limit or otherwise control the powers of the Delegate, including via the powers invested in the Regional Assembly cited in this Act.

 

i. The 'powers of the Delegate' shall hereby be defined as the abilities of the Delegate in-game, including but not limited to the ability to change the World Factbook Entry for the region, and the ejection & banning of nations from the region.

3. The Regional Assembly membership shall be open to all forum members that have a nation within the West Pacific region of NationStates.

 

i. In certain exceptional circumstances, membership to the Regional Assembly can be granted to a prospective member without a nation in the West Pacific. In these circumstances, prospective members that cannot provide a nation will be required to prove to the standing Regional Assembly why they cannot provide a nation. Should the standing Regional Assembly deem this to be an acceptable reason, membership shall be granted by a majority vote of the standing Regional Assembly.

ii. Non-voting 'Observer' status may also be granted to those whom cannot, or do not wish to, provide a nation in the West Pacific. 'Observer' status will be granted upon a majority vote of the standing Regional Assembly.

a) Members with 'Observer' status may give opinions on Assembly matters within the chambers of the Regional Assembly but do not have voting privileges.

4. The Regional Assembly may establish criteria and procedures for terminating or suspending membership, provided such terms and methods are prudent, clear, and not unduly burdensome or unreasonable.

5. The Regional Assembly shall elect one of its members to the office of Prime Minister who shall oversee the functions of the Regional Assembly.

6. The Regional Assembly shall create legislation defining its functions, rights, and powers.

7. The Regional Assembly may create and staff Ministries it considers of benefit to the region and to the Forum. Any such creation will require a description of duties and responsibilities.

8. The Regional Assembly may question the Delegate about the intentions and performance of his/her duties.

9. The Regional Assembly will from time to time adopt [non-Amendment] resolutions by simple majority vote to communicate approval, diffidence, or disapproval of the current or prospective Delegate, to suggest endorsement or un-endorsement or other action up to and including a Declaration of Open Rebellion to the various nations of the region, and to cite the causes and articulate the reasoning of such positions and suggestions.

 

i. A Declaration of Open Rebellion must include an enumerated List of Grievances against the Delegate and will require a majority vote by the Regional Assembly. The terms of majority will be determined in the Regional Assembly prior to the vote and stated in the Declaration of Open Rebellion.

ii. In the event the Regional Assembly declares a Declaration of Open Rebellion, the Prime Minister shall petition the Forum Administrators to revoke all of the Delegate's extra-member privileges and the Regional Assembly. The Regional Assembly may elect a Rebellion Leader, designated to serve until either a new Delegate is placed in office or until mutually agreeable terms are made between the Delegate and the Regional Assembly.

10. The HGA has the duty to monitor all citizens and community visitors to ensure freedom from Roofur Madness and other afflictions brought about by contamination by Marsupials.  Should contaminated individuals be located the HGA is further obligated to isolate said individual for treatment and re-education.  Upon satifactory recovery, all individuals will be returned to society as productive supporters of anti-marsupialism.

 

The HGA shall petition the seated Delegate for removal of Marsupials and the afflicted from the region.  The Delegate may elect to grant the petition or may choose mercy.

It is the duty of every resident of TWP to ensure a happy, healthy region free of the evil Marsupial menace

The Role of the Prime Minister of the Regional Assembly Act

Effective 30-August-2013.

Article 1

1. The term of a Prime Minister ends when one of the following scenarios are confirmed.

a. The Prime Minister completes 3 months in the role;

b. The Prime Minister resigns;

c. The Prime Minister is removed following a majority vote of the standing Regional Assembly, as detailed in Article 2, Section 5 of this document.

2. The Prime Minister of the RA will be elected following the guidelines established on the General Election Guidelines Act.

Article 2

1. The Prime Minister shall hold all votes in the RA, and shall be responsible for closing them once the time for voting has passed.

a. This includes the votes to be held as per Article 1 of this Act.

2. The Prime Minister shall be responsible for maintaining the roster of RA members.

a. This includes the ability to evict members from the RA. A simple majority by the remaining RA will be required to negate such evictions.

3. The Prime Minister shall be responsible for maintaining the activity of the RA.

4. The Prime Minister may appoint Deputies to assist in their role, if they wish, and may have the power to temporarily take over the Prime Minister’s role if the Prime Minister has to be absent.

5. The RA may choose to remove the current Prime Minister by a majority vote. If successful, the Prime Minister shall have to relinquish power of the RA and will become a normal voting member of the RA again. If unsuccessful, a period of one week will be required before another vote can be held.

6. The Prime Minister may announce Declarations by which they shall oversee the RA. These Declarations may be of any nature, must obey

existent regional law, and their jurisdiction shall end outside the RA. Declarations may not take effect until they are posted in the RA sub-forum for all members to see.

a. The Regional Assembly may choose to negate any such Declaration by a simple majority vote, at any time that it is effective.

b. Declarations end as soon as the Prime Minister who devised them leaves office, although subsequent Prime Ministers may choose to keep them in effect.

The Role of the Speaker of the Regional Assembly Act

Effective 30 August, 2013

 

Article 1

1. The term of a Speaker ends when one of the following scenarios are confirmed.

a. The Speaker completes 3 months in the role;

b. The Speaker resigns;

c. The Speaker is removed following a majority vote of the standing Regional Assembly, as detailed in Article 2, Section 5 of this document.

2. Nominations for the new Speaker begin as soon as one of the situations in Article 1, Section 1, has occurred.

3. The members of the Regional Assembly, hereafter referred to as the RA, may hold nominations for the new Speaker for 3 days.

Nominees may begin campaigning as soon as they have accepted their nomination.

4. Nominees for Speaker must satisfy the following criteria:

a. They must have held a forum account for 1 month;

b. They must have been a member of the RA for 2 weeks;

5. After the nomination period, a 5 day plurality vote shall be held in the RA to determine who the next Speaker shall be. There shall be the option for voting RA members to abstain. RA members are required to state their votes in posts for them to be counted.

a. If there is only one accepted nomination, a consent vote shall follow the same principle of requiring a plurality vote.

b. In the event of a tie, a run-off election shall be held.

The Civil Code for Uniform Justice and Order in the West Pacific

The offenses listed below are punishable by banishment to the realms outlying the vast region of The West Pacific:

The West Pacific Armed Forces Bill

Effective as of 14 October, 2014

 
Preamble

The collection, analysis and distribution of information vital to safeguarding the sovereignty of The West Pacific and its allies is of paramount importance to The West Pacific. This bill seeks to merge the existing functions of the Imperium Secret Service (ISS) and The West Pacific Armed Forces (TWPAF) and assign additional responsibilities to their officers by the creation of a new entity called The West Pacific Department of Defense (TWPDD). This action has become necessary because experience has shown that The West Pacific's regional interests cannot best be served by operating ISS and TWPAF in isolation, as evidenced by the fact that there has been no cooperation between these organisations over the past year.

ARTICLE 1
a-) The Imperium Secret Service (ISS) will merge with The West Pacific Armed Forces (TWPAF).

  • The components of the merger (ISS and TWPAF) will cease to exist as individual entities and become known as the singular authority, The West Pacific Department of Defence.
  • The ISS and TWPAF will be replaced within The West Pacific Department of Defence by two autonomous divisions namely that of the Intelligence Division and the Battle Division.
  • When appropriate, the Intelligence Division and the Battle Division will aid each other in the common goal of safeguarding The West Pacific's regional interests.

b-) The role of Field Commander will be expanded to accommodate for the nature of The West Pacific Department of Defence.

  • The title of Field Commander will be held by an individual appointed by the Prime Minister from The West Pacific Department of Defence: Intelligence Division, or from the Battle Division.
  • The ​Field Commander will maintain full functional authority over The West Pacific Department of Defence.
    • The Field Commander will select a member of the Battle Division of advanced knowledge and proven skill over Game Mechanics to become War Lord.
    • ​The Field Commander will select a member of the Intelligence Division of advanced knowledge and skill over the practise of acquiring covert information to become Spymaster General.
    • The War Lord and Spymaster General will be of equal rank beneath the Field Commander.
    • The War Lord will maintain complete authority over the Battle Division and the Spymaster General will maintain complete authority over the Intelligence Division.

Article 2
a-) All articles/documents produced by The West Pacific: Department of Defence for internal distribution only are strictly classified.

  • Those suspected of replicating or distributing classified documents to anyone outside The West Pacific: Department of Defence without the express permission of the ​Field Commander or the Prime Minister will have their access immediately revoked.
    • Those found guilty of replicating or distributing classified documents to anyone outside The West Pacific: Department of Defence will be immediately expelled from the organisation so as to remove the security risk and the matter referred to the Judiciary of The West Pacific Imperium under the charge of High Treason.

b-) Any action performed in the name of either the Battle Division or the Intelligence Division must be approved by the relevant departments head for the action to become recognised by The West Pacific.

General Election Guidelines Act

Effective as of 11-March-2015

1. Any and all elected positions defined by the legislation of the HGA shall be elected following the guideliness in the General Election Guidelines Act.

2. The members of the Regional Assembly, hereafter referred to as the RA, may hold nominations for the open position for 3 days.

Nominees may begin campaigning as soon as they have accepted their nomination.

3. Nominees for any position must satisfy the following criteria:

 

a. They must have held a forum account for 1 month;

b. They must have been a member of the RA for 2 weeks;

c. Any other requirement explicitly stipulated by the law or act that governs the position to be elected;

4. After the nomination period, a 5 day plurality vote shall be held in the RA to determine the election result. There shall be the option for voting RA members to abstain. RA members are required to state their votes in posts for them to be counted. Multiple positions can be voted for in the same election.

 

a. If there is only one accepted nomination, a consent vote shall follow the same principle of requiring a plurality vote;

b. In the event of a tie, a run-off election shall be held starting 3 days after the election results are given; the candidates tied up can campaign during this time but no other candidates are allowed to continue campaigning;

5. Only members of the RA at the start of the voting period are eligible to vote during the election; in case that a run-off election is required, new members who joined the RA after the original voting period will remain ineligible to vote.

6. The periods and election dates of eligible positions shall be dictated by the laws that create or govern those positions, and this act only describes and rules the election process to be held for those positions.

7. Article 1, of "The Role of the Prime Minister of the Regional Assembly Act" shall be modified as follows:

 

a. Section 2 shall read "The Prime Minister of the RA will be elected following the guidelines established on the General Election Guidelines Act";

b. Sections 3 to 5 are rendered null and void;

1. All references to an office of "Speaker" in laws previously passed by the legislature shall hereby be replaced with references to the office of "Prime Minister."

The Executive Council Act

Effective 11-April-2015

 

1. The Holy Grand Assembly hereby establishes the Executive Council of the West Pacific.

a. The Executive Council will be tasked with carrying out all commands and laws of the regional legislature, defending the region's security, serving as an advisory body to the delegate, and promoting the regional welfare.

b. The Executive Council will be headed by the Prime Minister, who will coordinate its activities, set its agenda, and assist all members of it in the completion of their duties.

c. The Executive Council will consist of Prime Minister and the Officers of Foreign Affairs, World Assembly Affairs, Community Affairs, and Home Affairs.

d. The Chief Justice shall be considered a non-member observer on the Executive Council, and have access to all Executive Council communications, but shall not be considered full members of the body.

2. The Holy Grand Assembly hereby establishes the Offices of Foreign Affairs, World Assembly Affairs, Community Affairs, and Home Affairs, each of which shall be headed by their own officer.

a. The Officer of Foreign Affairs will, in consultation with the Prime Minister, be responsible for coordinating diplomatic interaction with other regions.

b. The Officer of World Assembly Affairs will be responsible for educating the nations of The West Pacific in regard to World Assembly matters, advising the delegate on how to vote, and advocating for proposals which he or she considers beneficial to the region's interests within the Security Council.

c. The Officer of Community Affairs will be responsible for facilitating community affairs, including but not necessarily limited to integration, culture, and role play.

d. The Officer of Home Affairs will be responsible for convincing recently-founded nations within TWP to remain within the region, increase the number of nations in the region who are both in the World Assembly and endorsing the Delegate to assist domestic security, and educate the people of the region so that they may grow to be active and productive citizens.

 

3. The Officers of the Executive Council will respond to the Prime Minister, and will be held responsible before the Prime Minister of their actions and omissions in the execution of their duties.

a. The Prime Minister may appoint and dismiss officers at his discretion.

b. The Regional Assembly may remove any members of the Executive Council through a vote of no confidence. In order to succeed, over three-fifths of all votes cast must be in favor of removing the incumbent minister.

4. Officers of the Executive Council may appoint deputies to assist in the execution of their prescribed duties.

a. Deputies may be removed by the legislature through a vote of no confidence, which in order to succeed will require a simple majority of all votes.

b. Deputies may also be removed by their respective Officer.

 

5. The ministries of World Assembly Affairs, Foreign Affairs, Interior Affairs, and Make-Believe existent prior to this Act are hereby dissolved.
