The only parties participating in the hearing will be the hearing applicant, Westwind, and the respondant, Zorn-Uzkul. Others may speak on request of either party, but only with the Court's permission.
As this is a hearing only, and no trial, the Court thinks a separate counsel for Zorn is not necessary. Should he however wish for someone to represent him, please make such arrangements as soon as possible. If he will not have internet access, please say so at the outset, and advise when access will be available.

The hearing will be about the West Pacific Dominion only. Opinions may be voiced, but we advise participants to keep personal feelings in check and not let these overrun the procedures. Appropriate action will be taken if it happens.

Biyah - given how TWP went for the next year, we really shoulda held onto Dominion.

Westwind - Zorn: "My involvement with the WPD was simply Biyah approached me and asked if I felt that NS was becoming boring. If I felt that it had become stagment, stail as it were. I responded, yes. I had noticed this. He then asked if I wanted to help change it. To help breath new life into The West Pacific. I again said yes, seeing no reason why this would be a bad course of action. At that time, no timeline was given to me, however nor did I ask for one. It was stated it wouldn't be right away.

After the leak, and Dilber stated he may step down, it was brought to my attention that I may be asked to take over for him. At this time I had interest. Biyah then told me that he would let me know of Dilber's decission as soon as he knew so that I could make the proper arrangements with Equilism's Military Minister about my enrollment.

I did not hear of the dissolving of the WPD until the next morning.

I wish to inform the court that I had no planned of the TWP constitution being dissolved, that I was approached to join in after all the plans were laid out. I was just a body who was helping with the transition. It was not in any way to harm Equilism, ADN or any other governing body. It was not my intent to have caused a stir. I too wish to put this all behind and move forward. I have learned much from my short experence.

To clarify from your statement, is it correct to say that you were not aware, prior to the announcement of The West Pacific Dominion, that the plan was to include the dissolution of the Constitution of The West Pacific and declare martial law ?
That would be correct. I was unaware that the plan included the dissolution of the Constitition and declare maetial law.

Were you, prior to being asked about the possibility of serving in Dilber's place, active in The West Pacific Defense Force, or in any other capacity in the region ?
No.

Were you aware that the announcement by the WPD would include your name as being a part of The Core ? Or rather, at what point did you become aware that you were listed as a part of The Core ?
I was aware yes.

When you stated that you would contact Military Minister Bismarcia about your participation with the West Pacific military, was it your intention at that time to accept the position offered to you as a member of The Core ?
I had thoughts of it, and it sounded interesting. It was a position at some point I had hoped to hold here, and with what was happening, I didn't see a reason why, helping an ally was a bad thing. I had not however finalized a decission, as I was waiting to speak with Bis concerning the matter.

Were you aware of the involvement of any other members of Equilism in the actions of the WPD ?
I was aware that Moo was approached, however I was not informed on his decission or lack there of.

When you agreed to becoming a part of the WPD, were you aware that the actions planned by these groups were against the constitution of The West Pacific? How much knowledge did you have on the political aspect of the WPD?
No, I was unaware of that. I had little to no knowledge. As I stated, I was just informed that they wanted to spice things up

If it may, I would like to present an outline of the events in The West Pacific, as I have come to understand them.

A group composed of most of the members of The West Pacific government, having concerns over the general low activity levels throughout NationStates, devised a plan with the intent to stir interest and activity in The West Pacific. As they considered this plan, they approached Prime Minister Moo-Cows with Guns and E-Army soldier Zorn Uzkul about participating in this plan.

Moo-Cows with Guns was offered the position of WPLF, which he turned down, due to his commitments here in Equilism. He was unaware, at any time, of the detail of the WPD plan.

TWP Defense Minister Dilber became disturbed about the plan, and suggested that he may step down. The remaining plan conspirators were concerned that their plan would be uncovered before it could be put into effect, and therefore accelerated their launch date.

Zorn Uzkul was approached about filling the Defense Minister position in replacement of Dilber.

The West Pacific Dominion made it's announcement, dissolving the Constitution of The West Pacific, and declaring Martial Law. In the announcement, Moo-Cows with Guns and Zorn Uzkul were both listed as being a part of The Core of the WPD. Moo soon announced that his name was listed without his permission, which was confirmed by the WPD which then removed his name.

Zorn Uzkul's name remained listed as a part of The Core of the WPD, in replacement of Dilber. After the announcement had been made, Zorn sought the council of Military Minister Bismarcia regarding his participation. At no time was Zorn Uzkul aware of the details of the WPD plan to dissolve the TWP Constitution.

Zorn Uzkul was not available online again until after the WPD had been disolved, and thereby had no further opportunity to be aware of the situation or respond to it.

It seems clear that there were good intentions on the part of those involved in the WPD and on the part of Zorn in seeking a means to invigorate activity in NationStates. However, it also seems clear that there may have been poor judgement in as much as Zorn did not seek to achieve a clear understanding of the plan of the WPD or the consequences of such actions. It is also unfortunate that Zorn did not seek the council of Military Minister Bismarcia until after the announcement of the WPD had occured.

Established Military Policy regarding participation in external Military groups states :

A. Participation with the ADN, A.L.L., or our allied regions, may be permitted, but must be cleared with the Ministry.

This implies that permission should be obtained prior to participation. However, it is worthy of consideration that the sudden decision of the conspirators of the WPD to enact their plans prematurely, directly impacted Zorn's ability to respond to the situation in a timely manner.

I thank the Judiciary for it's time and consideration, and thank Zorn and Moo for their statements and efforts at assisting us in understanding these events.
